These Terms & Conditions govern all purchases made through nicolassimionshop.com. By placing an order, you agree to these terms in full.

2. Products

We sell physical music CDs through our online store. Product descriptions, images, and prices are provided as accurately as possible. We reserve the right to correct errors or update product information without prior notice.

3. Ordering Process

By clicking "Place Order", you make a binding offer to purchase the selected products. A purchase contract is concluded when we send you an order confirmation by email. We reserve the right to decline orders at our discretion, in which case any payment made will be fully refunded.

4. Prices & Payment

All prices are displayed in EUR and include applicable VAT where required. Payment is processed securely through Stripe. We accept major credit and debit cards. Full payment is due at the time of placing your order.

We do not store your card details. All payment data is handled directly by Stripe in accordance with PCI-DSS standards.

5. Shipping & Delivery

We ship via standard postal service and courier (DHL / Deutsche Post). Estimated delivery times after dispatch:

• Germany: 2–5 business days
• European Union: 5–10 business days
• International: 10–21 business days

Shipping costs are displayed at checkout before payment is taken. We are not responsible for delays caused by postal services, customs authorities, or circumstances beyond our control.

6. Transfer of Risk

Risk of loss or damage passes to the customer upon handover of the goods to the shipping carrier. If a shipment is lost or arrives damaged, please contact us immediately at nicolassimion@gmail.com with your order number and we will assist you.

7. Warranties

You are entitled to statutory warranty rights under German law (BGB §§ 434 et seq.). If a product is defective upon receipt, you may request repair, replacement, a price reduction, or a full refund. Please report any defects within 2 months of discovery. The statutory warranty period is 2 years from delivery.

8. Liability

We are fully liable for damages resulting from intentional acts or gross negligence. For cases of minor negligence, liability is limited to foreseeable, contract-typical damages. Liability for indirect or consequential damages is excluded to the extent permitted by applicable law.

9. Intellectual Property

All content on this website — including product images, descriptions, logos, and design — is protected by copyright. Reproduction, distribution, or use of any content without prior written permission is strictly prohibited.

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
